ARTICLE 1: PREAMBLE

  • The customer declares that they have full legal capacity to commit to these Terms and Conditions of Sale, i.e. that they are at least 18 years of age and are not under guardianship or trusteeship.
  • The customer declares that they are booking services for personal and private use, or, where applicable, that they are benefiting privately from a personal booking within a group booking (several individuals, associations, companies, works councils, or other).
  • These General Terms and Conditions of Sale express the entirety of the obligations of the parties.

ARTICLE 2: DEFINITIONS

  • Accommodation and meals package: service including accommodation in one of the establishments belonging to SA Casa Pairal and a breakfast meal plan.
  • Accommodation only: service including only accommodation in one of the establishments belonging to SA Casa Pairal, excluding any meal plan.
  • SA Casa Pairal is the company that owns the establishments listed in Appendix 1.
  • SA Casa Pairal websites: refers to the websites www.hotel-casa-pairal.com and www.hotel-mas-des-citronniers.com.
  • Travel agent/service provider: reseller with commercial agreements with SA Casa Pairal and authorized to sell its services.

ARTICLE 3: CONTENT

  • These General Terms and Conditions of Sale define the rights and obligations of the Parties in connection with the booking of services offered by SA Casa Pairal.
  • These General Terms and Conditions of Sale may be modified at any time without notice. These modifications shall not apply to reservations made prior to such modification. Only the General Terms and Conditions of Sale in force at the time of reservation shall be enforceable against the customer.
  • The customer acknowledges having read and accepted these General Terms and Conditions of Sale.

ARTICLE 4: SERVICES OFFERED BY SA CASA PAIRAL

  • The services offered by SA Casa Pairal are detailed on the establishments' websites.
  • All accommodation and catering packages include breakfast. They do not include drinks, tourist taxes, or any additional services that the customer may wish to use during their stay (telephone, laundry, etc.).
  • Accommodation only (as defined in Article 2) refers to the provision of accommodation in one of the establishments of SA Casa Pairal, excluding any catering services.
  • The accommodation and catering package (as defined in Article 2) refers to the provision of accommodation in one of the establishments of SA Casa Pairal as well as a breakfast catering package.
  • Children may only access the swimming pool when accompanied by a parent, in accordance with the specific conditions and opening hours of each establishment, as stated on the SA Casa Pairal websites.
  • The breakfast times stated on the SA Casa Pairal websites are specific to each establishment and are subject to change without prior notice.

ARTICLE 5: PRICES

The customer guarantees that they are fully authorized to use the payment method provided for the payment of their order and that this method gives access to sufficient funds to cover all costs resulting from the purchase of their service.
The prices indicated are displayed in euros, including tax, and are only valid for the dates indicated on the booking confirmation.
Prices include VAT applicable on the day of booking and any change in the applicable VAT rate will be automatically reflected in the prices indicated.
For hotel stays, unless otherwise stated in the description of the stay, the prices displayed do not include the following optional costs and services:

  • tourist tax;
  • medical fees**;
  • pets;
  • insurance;
  • meals not included in the chosen package;
  • drinks;
  • activities not included in the chosen package;
  • additional services (laundry, etc.);
  • and, in general, all personal expenses not included in the chosen package.

ARTICLE 6: BOOKING SERVICES

Bookings can be made with each establishment using the contact details provided on their website (see Appendix 1). Bookings can be made by phone, email, or mail.

ARTICLE 7: CONFIRMATION OF THE RESERVATION

Following their order, the customer will receive a reservation confirmation.
Confirmation of the customer's reservation by the establishment is subject to receipt of payment for the services in accordance with the terms set out in Article 9.
The reservation confirmation summarizes the services ordered and the corresponding prices.

ARTICLE 8: PAYMENT FOR SERVICES

Unless a special offer requires payment of the full amount of the service at the time of booking, the customer must pay a deposit of 30% of the total amount of the service at the time of booking; the balance is payable:

  • for hotel stays, before the customer leaves at the end of their stay.

The customer may also choose to pay the full amount corresponding to the service at the time of booking.
Customers arriving directly at reception who are not registered in our customer database must pay the full amount of the booking upon arrival.
In the event of early departure, the credit card will be debited for the full amount of the booking when the customer checks out at reception.

  • Reservations for accommodation only (as defined in Article 2 hereof) will only be taken into account after the establishment concerned has debited the guarantee amount representing 30% of the total amount of the service.
    The balance will be paid:
    - in the case of a hotel stay, on site, at the establishment chosen at the time of departure.
  • Early Booking/Preview rates require full prepayment of the total cost of the stay at the time of booking. These offers can be modified or canceled up to 20 days before the guest's arrival (except for those at the Hotel La Casa Païral). After this period, the customer will not be entitled to any refund or change to their stay in the event of cancellation.
  • Promotions and discounts cannot be applied retroactively under any circumstances.
  • Any services not used will not be refunded.
  • Payment can be made by bank transfer, vacation check, or credit card (Carte Bleue, Visa, American Express, MasterCard/Eurocard) held by the person making the reservation. In the case of payment by credit card, the customer acknowledges that they have given authorization to debit the corresponding amount.
  • In accordance with Article L133-8 of the Monetary and Financial Code, and unless otherwise provided by law, the user of payment services may not revoke a payment order once it has been received by the payer's payment service provider.
  • As a guarantee, the hotel reserves the right to make a bank pre-authorization on your credit card upon arrival. It will be lifted on the day of departure and according to the bank's terms and conditions on your credit card. No debit request is made.
  • For security reasons, upon arrival at the hotel, your ID will be checked against your method of payment. The holder of the ID presented at reception must be the same person making the payment (credit card/vacation check). Thank you for your understanding.

ARTICLE 9: EXTERNAL SERVICE PROVIDERS AND PARTNERS

  • Articles 7 and 8 above do not apply in the case of online bookings made through the website of a Travel Agent/Service Provider that has an agreement in force with the establishment concerned. The applicable booking and payment terms and conditions are those of the travel website in question.
  • In any event, the customer must have, before the start date of the stay, a voucher from the Travel Agent/Online Service Provider to whom they have paid for the service corresponding to the reservation.
  • We cannot be held liable for the information provided by third parties and tourist offices, nor can we be held liable for any compensation for work or developments undertaken by municipalities, local authorities, or private individuals. Certain shops, restaurants, activities, and entertainment may be closed at the beginning and/or end of the season without this resulting in a reduction in the price of the stay or giving rise to compensation from us.

ARTICLE 10: CHANGES MADE BY THE CUSTOMER

  • Any change to the dates of the service, the number of people, or the services booked, subject to acceptance by the establishment concerned, will result in an increase or decrease in the initial price. The amount owed by the customer will be that of the modified stay.

  • In the event that SA Casa Pairal is unable to accommodate requests for changes, SA Casa Pairal cannot be held liable and if the customer wishes to cancel their reservation as a result, the cancellation conditions in Article 14 shall apply.
  • Any transfer of a stay to a third party is only possible under the provisions of Article L211-11 of the Tourism Code.

ARTICLE 11: CANCELLATION BY THE CUSTOMER

  • Customers are reminded that, in accordance with Article L.221-28 12° of the French Consumer Code, they do not have the right of withdrawal provided for in Article L.221-18 of the French Consumer Code.
  • All cancellations must be made in writing (by email or post) and will result in:

For stays at La Casa Païral hotel

Low and mid season:

  • Cancellations made 2 days or more before the arrival date: full refund of the deposit,
  • Cancellation between 1 day and less than 1 day before the arrival date: the deposit paid at the time of booking will be retained and the total amount of the stay will be charged (i.e., 100% of the stay will be charged),
  • No-show or interruption during the stay: 100% of the stay will be charged.

High season and public holiday weekends High season period: July 5, 2025 to September 20, 2025 inclusive, and public holiday weekends.

  • 5 days or more before the start date of the service: refund or postponement at no extra cost of the deposit paid at the time of booking
  • 4 days or less before the start date of the service: retention of the deposit paid at the time of booking and payment of the total amount of the stay.

Preview Offers: Non-cancellable and non-refundable.

For stays at Le Mas des Citronniers hotel

High season and Low and mid season:

  • Cancellation 2 days or more before the arrival date: full refund of the deposit.
  • Cancellation between 1 day and less than 1 day before the arrival date: retention of the deposit paid at the time of booking and a charge for the total amount of the stay (i.e., 100% of the stay will be charged).
  • No-show or interruption during the stay: 100% of the stay will be charged.

High season and public holiday weekends (high season period: June 14, 2025 to September 13, 2025 inclusive and public holiday weekends.

  • Cancellation 5 days or more before the arrival date: full refund of the deposit,
  • Cancellation 4 days or less before the arrival date: the deposit paid at the time of booking will be retained and the total amount of the stay will be charged (i.e., 100% of the stay will be charged).
  • No-show or interruption during the stay: 100% of the stay will be charged.

For all establishments belonging to SA Casa Pairal

In the event of a no-show or interruption during the stay: 100% of the total amount of the stay will be charged.

SA Casa Pairal informs its customers of the existence of an insurance contract covering the consequences of cancellation: it is possible, on request and subject to conditions, to take out cancellation insurance by telephone with an SA Casa Pairal advisor on +33 4 68 82 05 81 or +33 4 68 82 05 82. The insurance will cover changes or cancellations made by the customer as specified in Articles 11 and 12. The General Terms and Conditions of Sale for the cancellation insurance offered by SA Casa Pairal are available on request from SA Casa Pairal advisors. If an insurance policy is taken out, the insurance premium must be paid at the time of booking, together with the amount of the guarantee.

ARTICLE 12: CANCELLATION BY SA CASA PAIRAL

  • If SA Casa Pairal is forced to cancel the service paid for by the customer, SA Casa Pairal will inform the customer and offer them the same services on other dates, subject to the customer's acceptance. If the customer refuses, they may then request a refund of double (without incurring any penalties or fees) the amount paid for the service. The refund will be made, at the discretion of SA Casa Pairal, by credit to the customer's bank account or by bank check.
  • If this cancellation is imposed by circumstances of force majeure, the customer will not be entitled to any compensation: Force majeure in contractual matters occurs when an event beyond the control of the debtor, which could not reasonably have been foreseen at the time of conclusion of the contract and whose effects cannot be avoided by appropriate measures, prevents the debtor from fulfilling their obligation (Article 1218 of the Civil Code), and in particular in the event of: strikes, insurrection and riots, climatic, geographical or health conditions likely to endanger the customer's life.

ARTICLE 13: CANCELLATION INSURANCE - INTERRUPTION OF STAY

SA Casa Pairal allows you to benefit from cancellation and interruption of stay insurance coverage taken out with Gritchen Assurance.

This optional insurance is payable in full at the time of booking, at the same time as the deposit, and is non-refundable.

ARTICLE 14: HEALTH AND SAFETY MEASURES - INTERNAL RULES AND REGULATIONS

  • Pets: Dogs classified as category 1 or 2 are prohibited in all our establishments. Upon prior declaration at the time of booking, only one pet per room or apartment is accepted in all our establishments, subject to a financial contribution. Pets must be kept on a leash in all common areas; however, they are not allowed near swimming pools or children's play areas. The pet's health record, rabies certificate, and tattoo are required. We reserve the right to refuse dangerous or aggressive animals or those that cause any disturbance in the establishments.
  • Parking: vehicle owners are solely responsible for any items or property left in their vehicle and for any damage to them. Only one vehicle is allowed per room or apartment.
  • Each establishment belonging to SA Casa Pairal has internal rules and regulations that can be consulted on site, which the customer undertakes to read before the start of their stay and to comply with. Appropriate attire is required at all times. Any behavior or comments that are contrary to public decency or public order will result in SA Casa Pairal asking the customer to leave the establishment, without any refund if payment has been made, or compensation. The customer undertakes not to invite any person whose behavior is likely to cause damage to the establishment, which reserves the right to intervene if necessary. The customer may not bring in any drinks or food from outside. The general ban on smoking in public places applies in the establishments.

ARTICLE 15: LIABILITY

  • The services offered comply with current French legislation. SA Casa Pairal cannot be held liable in the event of non-compliance with the legislation of a third country.
  • SA Casa Pairal cannot be held liable for the non-performance or poor performance of the reservation in the event of force majeure, in the event of an act by a third party or an act by the customer.
  • The photographs, graphic representations, and descriptions appearing on the websites of SA Casa Pairal correspond to the room categories mentioned. The layout of the facilities may vary slightly from one room to another, in accordance with the description of the category.
  • Casa Pairal SA cannot be held liable for theft or damage to personal belongings inside or outside the rented rooms or apartments, or to the vehicle and its contents. Guests are required to take out insurance with an insurance company against the risks inherent in their stay, namely: theft, loss, or damage to their personal belongings, as well as for any damage they may cause to the rented room or apartment and also for any damage they may cause to the buildings as a whole, whether through their own actions or through negligence. Casa Pairal SA cannot be held liable for unforeseeable circumstances or force majeure such as climatic disasters or external disturbances that may disrupt, interrupt, or prevent the stay. If circumstances force us to do so, in the event of force majeure events beyond our control, we may be obliged to modify our programs partially or totally (total or partial closure of a site, shared facilities such as a swimming pool, garden, restaurant, etc.). Force majeure events shall in no way give rise to a reduction in the price of the stay or compensation from us.

ARTICLE 16: PRIVACY

  • The information requested from the customer is necessary for processing their reservation and will be stored in the shared database of SA Casa Pairal. If this information is not provided, SA Casa Pairal will be unable to process the reservation.
  • The customer may write to the establishment concerned, whose contact details are indicated in the “Booking Confirmation” section, to exercise their rights of access, opposition on legitimate grounds or without grounds in the case of prospecting, and rectification with regard to information concerning them and processed by SA Casa Pairal, under the conditions provided for by the law of January 6, 1978. SA Casa Pairal declares that it has completed any formalities required by the French Data Protection Authority (Commission nationale de l'Informatique et des libertés).
  • The information that the customer provides to SA Casa Pairal when placing an order is not passed on to any third party. This information is considered confidential by SA Casa Pairal. It is used solely by the internal departments of SA Casa Pairal for the purpose of processing the customer's order and to enhance and personalize communication and the range of services offered to customers of SA Casa Pairal.
  • The customer has the option of expressly consenting to receive direct marketing in the form of email or postal mail. The customer has the option of objecting, by email or by registered mail with acknowledgment of receipt, to the use of their data for marketing purposes, in particular commercial marketing.
  • In accordance with Article L.223-1 of the French Consumer Code, customers who do not wish to receive commercial marketing calls may register free of charge on a list of numbers excluded from telemarketing. This list is available on the following website: www.bloctel.gouv.fr

ARTICLE 17: INTELLECTUAL PROPERTY

  • All text, images, and sounds reproduced on the websites of each establishment are protected by intellectual property rights worldwide.
  • These General Terms and Conditions of Sale do not entail any transfer of intellectual property rights of any kind over elements belonging to SA Casa Pairal or its beneficiaries, such as photographs, images, literary texts, artistic works, trademarks, graphic charters, and logos, to the customer.
  • Internet users who have a personal website and wish to place a simple link on their site for personal purposes that directs to the home page of one of the establishment's websites must obtain the prior and express authorization of SA Casa Pairal to establish this link.
  • In any event, hypertext links to the websites of SA Casa Pairal establishments must be removed at the first request of SA Casa Pairal.

ARTICLE 18: APPLICABLE LAW

  • The applicable law is French law.
  • In the event of a dispute, and in the absence of an amicable agreement between the parties, the court with territorial jurisdiction shall have jurisdiction.

ARTICLE 19: TERMS AND CONDITIONS FOR THE PROCESSING OF COMPLAINTS BY SA CASA PAIRAL

  • The customer must allow SA Casa Pairal a reasonable amount of time to investigate the complaint and remedy it, if necessary.
  • If no solution is found within 45 days of the customer's complaint to Customer Service, the customer may refer the matter to the Tourism and Travel Mediator, whose contact details are provided in Article 20 of these General Terms and Conditions of Sale.

ARTICLE 20: REFERRAL TO THE CONSUMER MEDIATOR
